EAPs and HIPPA - Where do we fit in?



Is your EAP ready for HIPAA? These regulations apply to EAPs more than you may have thought. EAPs and their affiliate networks operate under a wide variety of business models, which can potentially be defined as health care plans, health care providers or business associates. To make effective decisions about compliance, you must first understand the regulations and their impact in order to make decisions about they apply to you or your organization. The deadline for compliance with the Privacy and Security portion of the regulations is April, 2003. Our newest training program will help you prepare.

The Health Insurance Portability and Accountability Act of 1996 was enacted to assure the privacy of individual’s identifiable health information, to provide greater operational efficiencies and to ultimately improve the delivery of healthcare services. Healthcare organizations will be required to fulfill the following:

  • Manage the use of and access to personal health information
  • Implement HIPAA compliant policies/procedures and business processes
  • Educate and train staff

Marilyn Gaipa created this training for Blair Consulting Group with a special emphasis on how internal and external EAPs will be affected by HIPAA regulations. This one-day course provides EA professionals with an overview of the regulations’ history and purpose and what to know in beginning to implement compliance within their organizations.

Blair Consulting Group offers two HIPAA courses, which can be taken together or separately. After completing the HIPAA Overview course, you may wish to take the HIPAA Implementation Course.




Course Objectives

  • Review the history of HIPAA and the key components of its regulations
  • Appreciate how EAPs will be impacted by HIPAA regulations
  • Determine how you can protect EAP individual clients’ health information by implementing privacy procedures and training staff
  • Understand the extent of clients’ rights included in the Privacy portion of HIPAA
  • Understand the HIPAA rules concerning consents and authorizations
  • Create procedures for EAP individual clients to inquire or to complain about the privacy of their individual health records
  • Transmit and receive protected health information in HIPAA-compliant format
  • Review the Security portion of the regulations, including information access controls, contingency plans, personnel security policies and physical safeguards, and determine how to comply with them
  • Learn the legal and liability consequences of HIPAA non-compliance
  • Align your EAP’s business strategy with successful HIPAA implementation
  • Determine how to use compliance with HIPAA in marketing strategies
